Terms & Conditions
1. About Us
This website is operated by Kate Viner Arts ("we", "our" or "us").
By using this website and placing an order, you agree to be bound by these Terms & Conditions.
2. Products
All artworks, wearable sculptures, jewellery and other products are subject to availability.
As many of our pieces are handcrafted, slight variations in colour, finish, patina and detail may occur. These variations form part of the character of the work and are not considered defects.
Product images are provided for illustrative purposes. While we make every effort to display colours and finishes accurately, variations may occur between screens and devices.
3. Pricing & Payment
All prices are shown in Pounds Sterling (£) and include VAT where applicable.
We reserve the right to amend prices at any time, although any changes will not affect orders that have already been accepted.
Payment must be received in full before an order is dispatched.
4. Availability & Made-to-Order Pieces
Some wearable sculptures and jewellery pieces may be made or cast to order.
Where a piece is not immediately available, an estimated production and delivery timeframe will be provided. Delivery dates are estimates only and may vary due to the handmade nature of the work.
If significant delays arise, we will contact you as soon as possible.
5. Delivery
We aim to dispatch in-stock items promptly.
Delivery times are estimates and cannot be guaranteed.
We are not responsible for delays caused by couriers, customs authorities or circumstances beyond our reasonable control.
Complimentary insured delivery on all UK orders.
International shipping is available worldwide and calculated at checkout. Any customs duties, taxes or import fees are the responsibility of the recipient.
Risk in the goods passes to you upon delivery.
6. Returns & Cancellations
For standard online purchases, you have the right to cancel your order within 14 days of receiving your goods in accordance with UK consumer law.
Returned items must be unused, unworn and returned in their original packaging.
Refunds will be processed within 14 days of receiving the returned item.
This does not affect your statutory rights.
Bespoke, personalised or commissioned works created specifically to your requirements are non-refundable unless faulty.
7. Faulty or Damaged Items
If your order arrives damaged or you believe it to be faulty, please contact us within 7 days of receipt and provide photographs where possible.
Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015.
8. Hallmarking & Authenticity
Where required by UK law, precious metal items will be hallmarked by a recognised UK Assay Office.
Each wearable sculpture is supplied with a certificate confirming its authenticity as an original work from the artist's studio.
9. Intellectual Property
All content on this website, including images, text, designs and artwork, remains the property of Kate Viner Arts and may not be reproduced, copied or used without prior written permission.
The purchase of an artwork does not transfer copyright.
10. Limitation of Liability
To the fullest extent permitted by law, our liability shall be limited to the purchase price of the goods supplied.
Nothing in these Terms excludes liability for death, personal injury, fraud or any liability which cannot legally be excluded.
11. Privacy
Any personal information provided through this website will be handled in accordance with our Privacy Policy.
12. Governing Law
These Terms & Conditions shall be governed by and construed in accordance with the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
